As a former Army Officer and graduate of West Point, I normally command a certain amount of respect. So, when the owners of an apartment complex denied my application because I didn’t fit the mold of their ideal tenant, I was offended and deeply hurt. Normally, I am able to stay level-headed under very demanding and stressful situations, but no matter how hard I tried, I was unable to put this situation behind me. Not only did this unfortunate situation cause me tremendous emotional distress, but it also caused a great deal of financial headaches, as well.

My children and I were being harassed by the resident manager at our apartment complex. Tenants were given three-day notices to vacate the property for allowing their kids to play outside in the common areas. I was told that children are not allowed to play on the property at any time. I met Mr. Fagan in April 2002. I needed to find some kind of help for a very deplorable situation at our apartment complex. The apartment rules prohibited children from playing outside in the common areas at the complex. Various reasons were given for the rules, including the fear of liability by the management, concern that kids could be hurt, or that they could trip over sprinklers. We liked living at the complex and had been living there peacefully for about four years before these new rules were enforced. All of a sudden, we were told our children could no longer be outside except to leave or enter the apartment. No longer could my 6-year-old daughter sit outside our apartment and read her books on the grass. My kids would sit at the screen door and look outside and cry. It was really getting bad. Simply put, our children had become prisoner's in our own home.

I live in Alaska and I have been looking for an apartment to rent with my four children. Recently, I called and asked to see a three-bedroom apartment that was for-rent. The landlord asked me who would be living there and I told him my four children and myself. He stated that a single lady lived downstairs and he would not rent (or even show) the apartment because four kids would make too much noise. He also stated that I should be looking for a downstairs unit.

The next day, after a quick search about discrimination, I found Craig Fagan’s website with the very helpful Q&A section about discrimination. I learned that it was illegal to refuse to rent an apartment to someone with children. I called Mr. Fagan’s office and left a message with information about what had happened. Within five minutes, Mr. Fagan returned my call, listened to me, and offered to write a letter to the landlord stating that what he had done was illegal. I live in an apartment complex in Las Vegas. Our landlord cannot stand kids doing kid things (skateboarding, bicycling, or riding their scooters). I fought with this problem for some time and knew that what he was doing was wrong, and I just didn't know my rights and how to handle the situation. It was getting worse over time. We were warned that if kids were caught playing outside, then the tenants were going to be fined and/or lose privileges. This is when I sought help from Mr. Fagan. Mr. Fagan was extremely helpful in my time of need. A letter was sent out to the landlord from Mr. Fagan and these so-called rules of his were squashed. I can't appreciate Mr. Fagan’s help enough for solving this problem. Without Mr. Fagan’s help, I would probably be living miserably.

Mr. Fagan was able to greatly assist me in giving me some advice on some little known facts. I
had moved with my wife and 3-year-old son from Hawaii. We moved into a gated apartment complex in Massachusetts. Two months after we moved in, another couple had moved in below us. The husband approached my wife early one morning and advised her that my son was walking too late and they wanted to see if there was something we could do about putting him to bed earlier or keeping him quiet. My wife was disturbed as she did not know
what to say about this request, after all my son is a 3-year-old.

We later received a notice from the management at the complex, advising us about the complaint and advising us that we needed to try to reduce the "noise." We approached the neighbor and promised to try to be more quiet. A month later, we received a second notice from the management at the complex, advising us that we needed to come in for a meeting if we could not resolve the problem with our son making noise.

I decided to do some research to determine if this request was legal. I was able to locate Mr. Fagan’s website. I contacted Mr. Fagan and he gave me very helpful information on what is considered reasonable noise in a complex in regards to kids playing and whether our neighbor could interfere. After consulting with Mr. Fagan, I advised the complex that I did not want to wait for them to call a meeting but I that wanted to call one. Thereafter, I met with them and the tenant below and provided the supporting facts and information that Mr. Fagan had provided to me. The information showed that it was illegal to require kids to be quiet inside their apartments. The tenant was upset and walked out of the meeting. However, the management of the complex
apologized and stated the matter was closed and would not be brought up again. The neighbor has since apologized and there have been no more issues.

While we recognize our rights now, we did try to make arrangements for our son to run a little less and play a little quieter and go to bed a little earlier. However, it was nice to know that we were right and have the right to let our child be a child.
